Welcome to Digicz B.V.. These Terms of Service ("Terms") govern your use of our web hosting services ("Services"). By using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Services.
1. Services Provided
Digicz B.V. provides web hosting services, including but not limited to shared hosting, VPS hosting, and dedicated servers. We reserve the right to modify or discontinue any aspect of our Services at any time.
2. Account Registration
- Eligibility: You must be at least 18 years old to register for an account.
- Account Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. Acceptable Use
- Prohibited Activities: You agree not to use our Services for any unlawful purposes or to host, store, or transmit any content that is illegal, infringing, or harmful.
- Resource Usage: You agree to use the resources provided by Digicz B.V. in a manner consistent with our guidelines. Excessive resource usage may result in account suspension or termination.
4. Payment and Billing
- Payment Terms: Fees for Services are due in advance and are non-refundable except as otherwise provided in these Terms.
- Billing Cycle: Services are billed on a monthly or annual basis, depending on the plan selected. Invoices must be paid within 14 days.
- Late Payments: Late payments may result in suspension or termination of Services.
5. Cancellation and Termination
- Cancellation by You: You may cancel your account at any time through the account management portal. No refunds will be issued for prepaid Services.
- Termination by Us: We reserve the right to suspend or terminate your account if you violate these Terms or engage in any activity that disrupts or harms our Services or users.
6. Data Backup and Security
- Data Backup: While we perform regular backups, you are responsible for maintaining your own backups of your data. Digicz B.V. is not liable for data loss.
- Security: We implement reasonable security measures to protect your data. However, we cannot guarantee complete security and are not liable for unauthorized access.
7. Limitation of Liability
To the maximum extent permitted by law, Digicz B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (i) your use or inability to use the Services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein.
8. Indemnification
You agree to indemnify and hold harmless Digicz B.V., its affiliates, officers, agents, and employees from any claim, demand, or damage, including reasonable attorneys' fees, arising out of or related to your use of the Services or your violation of these Terms.
9. Changes to Terms
We may modify these Terms at any time. We will notify you of any significant changes by posting the new Terms on our website and/or sending an email to the address associated with your account. Your continued use of the Services after such changes will constitute your acceptance of the new Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these Terms shall be resolved in the courts of Amsterdam, Netherlands.
